BROKEN ARROW EVENTS: AIRSOFT RENTAL AGREEMENT
This Equipment Rental Agreement (“Agreement”) is made and effective as of the date of signature below, between Broken Arrow Events (the “Owner”) and the undersigned participant (the “Renter”).
1. EQUIPMENT DESCRIPTION AND CONDITION
The Owner hereby rents to the Renter one (1) Vietnam-era M16A1 airsoft replica, including associated magazines, batteries, and accessories (the “Equipment”). The Renter acknowledges that the Equipment is provided in “Field-Ready” condition. A pre-rental inspection shall be conducted by both parties to document any pre-existing cosmetic wear. The Renter agrees that the Equipment is in good working order and suitable for its intended use in a military simulation environment.
2. FINANCIAL TERMS: FEES AND DEPOSITS
The Renter agrees to a Rental Fee of $99.00, which is payable immediately upon online reservation. In addition, the Renter shall provide a Refundable Security Deposit of $50.00.
- Deposit: The $50 Security Deposit will be refunded in full upon the return of the Equipment in the same functional condition as received, barring “Normal Wear and Tear” (as defined in Section 3).
- Liability Ceiling: The Renter acknowledges that the total replacement value of the Equipment is $250.00. The Security Deposit is a good-faith hold and does not represent the maximum liability of the Renter. In the event of total loss or catastrophic damage, the Renter is liable for the full replacement cost minus the deposit already paid.
3. STANDARDS OF CARE AND DAMAGE DEFINITIONS
Given the nature of military simulation, “Normal Wear and Tear” is expected. This includes minor scratches to the finish, light mud, and finish wear on contact points. However, the Renter is responsible for damage resulting from negligence or misuse, categorized as follows:
- External Damage: This includes, but is not limited to, cracked receivers, snapped stocks, broken flash hiders, bent outer barrels, or missing pins/sights. If the structural integrity of the replica is compromised due to a fall, impact, or improper transport, the Renter will forfeit the Security Deposit and may be billed for parts.
- Internal Damage: The Renter shall not attempt to disassemble the gearbox, adjust motor height, or tamper with internal electronics. Internal damage caused by “forcing” the trigger, using unapproved ammunition, or water submersion will be assessed by the Owner’s staff and may result in a forfeiture of the deposit to cover tech labor and parts.
- Modifications: The Renter is strictly prohibited from painting, weathering, or removing any part of the replica. Any unauthorized permanent cosmetic changes will result in an automatic forfeiture of the $50.00 deposit.
4. LOSS OF EQUIPMENT AND ACCESSORIES
The Renter is responsible for the Equipment from the moment of check-out until it is officially checked back in by a Broken Arrow Events staff member.
- Lost Magazines: Each lost or unreturned magazine will result in a $10.00 deduction from the Security Deposit.
- Lost Speed Loaders: Each lost or unreturned speed loader will result in a $7 deduction from the Security Deposit.
- Lost Rental: If the replica is lost, stolen, or otherwise not returned, the Renter agrees to pay the Full Replacement Value of $250.00. The Renter’s $50.00 deposit will be applied to this balance, and the remaining $200.00 will be billed immediately to the Renter’s account or card on file.
5. SAFETY AND ASSUMPTION OF RISK
The Renter agrees to operate the Equipment in accordance with all event safety rules and local laws. Broken Arrow Events is not liable for any injuries, accidents, or damages to persons or property arising from the Renter’s use of the Equipment. The Renter assumes all risks associated with the handling of an airsoft replica in a field environment.
